Terms of Service
The rules for using GenerativeFill.ai, including credits, refunds and content ownership
1. Agreement
These Terms govern your use of GenerativeFill.ai ("the Service"), operated by [YOUR_ENTITY] ("we", "us"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.
2. Accounts
You need an account to upscale images. You must give an accurate email address, keep your password secure, and are responsible for activity under your account. You must be at least 13 years old.
We may suspend or close an account that breaches these Terms, is used to abuse the Service, or is used unlawfully.
3. Credits
The Service is metered in credits.
- Each job costs a number of credits shown before you start it. The price depends on the mode you pick and the size of the output.
- Credits are deducted when the job starts processing, not when you submit it.
- If a job fails, its credits are refunded automatically. If a job stops responding, an automatic sweep refunds it.
- Credits do not expire and have no cash value. They are a prepaid entitlement to use the Service, not a stored-value instrument, and cannot be transferred or exchanged for money.
- We may change credit prices for future jobs. Changes never re-price a job you have already run.
4. Payments and refunds
Credits are sold as one-time purchases. There is no subscription.
Payments are processed by our payment provider; we never receive your card details.
Because credits are consumed by immediate machine processing, purchased credits are non-refundable once spent. If you have an unused balance and believe a purchase was made in error, contact support@generativefill.ai and we will review it in good faith. Where local consumer law grants you a stronger refund right, that law prevails over this section.
If a purchase is charged back or refunded after some credits were already spent, the shortfall becomes a negative balance that future purchases clear first.
5. Your images and your rights
You keep all rights to the images you upload and to the upscaled results. We claim no ownership of them.
You grant us only the limited permission needed to run the Service: to store your image, transmit it to our AI processing provider, produce the upscaled result, and store and serve that result back to you. This permission ends when the files are deleted.
We do not use your images to train models, and we do not publish, sell or share them.
6. What you may upload
You confirm that you own the rights to the images you upload, or have permission to use them.
You must not upload:
- Content that infringes anyone's copyright, trademark or other rights;
- Sexual content involving minors, or any content that is illegal where you or we operate;
- Content designed to impersonate a real person in a deceptive way;
- Malware, or files crafted to attack our systems.
We may refuse or stop processing content that breaches this section. Our AI provider also runs its own safety filters, which may reject an image independently of us — where that happens, the job fails and your credits are refunded.
7. Using the results
You may use upscaled images for any lawful purpose, personal or commercial — online stores, websites, advertising, social media and client work included — provided you hold the rights to the original. Upscaling changes the file; it does not change who owns the underlying content.
Results produced on a free credit balance carry a small watermark. Purchasing credits removes it.
8. Service limits
Current limits: JPG, PNG and WebP input, up to 10MB per file, one image per job, with a cap on total output size. We may adjust these.
9. No guarantee of quality
Upscaling predicts detail that was not in your file. It works well on images with recoverable structure and poorly on images that are already heavily blurred or compressed.
The Service may alter fine detail, and may render text, numbers, faces or logos differently from the original. Inspect results at full size before relying on them, particularly for packaging text, documents, medical or legal material, or anything where accuracy matters. You are responsible for checking that a result is fit for your purpose.
10. Availability
We aim to keep the Service running but do not guarantee uninterrupted availability. We may change, suspend or discontinue features. We are not liable for downtime, and jobs that fail during an outage have their credits refunded.
11. Liability
The Service is provided "as is", without warranties of any kind to the extent permitted by law.
To the maximum extent permitted by law, our total liability to you for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profits or lost data.
Nothing here limits liability that cannot be limited by law.
12. Changes to these Terms
We may update these Terms. Material changes will be announced in the product and the date below will change. Continuing to use the Service after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of [YOUR_JURISDICTION], and disputes are subject to the courts of [YOUR_JURISDICTION], without prejudice to mandatory consumer protections in your country of residence.
